MAGISTRATE’S COURT.

* MONDAY, JUNE 26. (Before Mr J. H.. Salmond, S.M.) TRESPASSING ON RECECOURSE. At the Magistrate’s Court pn Monday Maurice Briggs was charged that being an excluded person he was found on the 17th March last on the Paeroa racecourse while it was being used for a race meeting by the Ohineinuri Jockey Club. Defendant did not appear. Detective Sweeny, said he had found defendant, who was an'-excluded person on account of previous convictions against him, on the Paeroa racecourse! on the date mentioned. A letter from defendant was read saying he had left the course immediately he had been warned. Detective Sweeny said it was defendant’s first offence of that kind. The Magistrate said he would inflict a nominal penalty of £1 and costs 7s, in default seven days’ imprisonment. Alfred Phillip Culhnn was simi.arly charged. Defendant pleaded guilty. Detective Sweeny said defendant had been ordered off the Claudel'ands racecourse during, the progress of the Rotorua races. It was his first offence of trespass. Defendant said he did not know that lie was forbidden fjor all meetings. The magistrate inflicted a similar penalty as in the previous case, and defendant was allowed one week in which to pay; ip default seven davs’ imprisonment. ARMS: ACT. Maxwell and Brash were charged that at Hikutaia they were in possession of ammunition for sale for sporting guns without being in possession of a dealer’s license under the Arms Act, 1920. Mr. Porritt appeared for defendants, Sergt. O’Grady said that defendants had a license which’ had expired on March 31. Mr. Porritt submitted that it was a genuine case ofj oversight, and wheh reminded by Constable McClinchy defendants had sent a cheque for the license. The magistrate said that such cases were liable to a fine of £lOO. Defendants were convicted and fined £2, and costs 17s, UNREGISTERED FIREARMS. Eric Spiers, of Hikutaia, was charged with being in possession of a firearm, to wit a double-barrelled shot-gun, and not being registered ai the owner. Mr. Hanna appeared for defendant, who pleaded guilty. Mr. Hanna said the gun had not been used while in defendant’s possession. The magistrate said there had been a tremendous number; of these cases, and ignorance of the law was no excuse. He pointed out that those guilty in cases such as this were liable to forfeit t'teir firearms. Defendant was fined £l, and- costs 17s. THE CIVIL LIST. The following judgments were made by default: Ellis v. Ryan, £3 8s 3d, costs £1 3s_ 4d; Fleming and Son v. F. G. Smith, £26 and costs. £3 2s ; F. J. Weils V.W. K. Dickson, £l5 0s 6d, and costs £2 16s ; Brocket and Shand v. F. Rose, £2l 0s Id, and costs £2 13s; Morgan Bros. v. Mrs. C. M. Houghton, £5 13 s Bd, and costs £1 Ils 6d ; Barnard and Smith v. G. Courtney, £7O 17s Bd, and costs £6 14's; D. McWatters v. D. Ryan, £l5 0s lid, and costs £2 14s. Judgment summonses were issued in the following : ' . Ellis v. H. Petry, £5 10s Bd, or five days imprisonment ; Wells v. K. Olla rd, £lB 6s at £3 per month, on 13 days ; Farmers’ Union Trading Co. v. H. Fciglcr, £3B 2s 3d at 10s per month, or 38 days’ imprisonment: Larkin v. J, Kotar-a, £7 18s at 10s per month. No order- was made ip the Farmers’ Uniop Trading Co. v. V. C. Gallagher.
