SHAREMILKER’S CLAIM.

DICKSON; V. HEWITT.

The leading case of the day at the Paeroa S.M. Court yesterday (Mr J. H. Salmon, S.M.) was that of J. G. Dickson, versus Mrs A. G. Hewitt, farmer, both of Waikino. The plaintiff claimed £l5O 19s-lOd, cost of building a

house apd work as alleged by plaintiff to have been .carried out by him. Mr E. J. Clendon appeared for plaintiff, and Mr, E. W.. Porritt for dei fendant. • Mr Clendon said that Mrs Hewitt had a section on the Await! Settle ment, which Dickson was manager of. Mr Dickson claimed wages at the rate of £3 per week, whereas the arrange ment was for 22/6 per week, Mrs Hewitt supplying the material. He mentioned this .to show the trickery of Mrs Hewitt. ,The £l5O 19s lOd was for .the price of the labour done by Dickson, as per arrangement with his sister, Mrs Hewitt. John G. Dickson, plaintiff in the case, said Mrs Hewitt had asked him to take charge, of the farm, as her husband would, not or could not manage it. It was arranged that he should be paid lfor all work done on the place, Mrs Hewitt ’supplying the « material, and he to pay a. rental of . 22s per week.. In about September he gavd Mr Hewitt £B5, which Mr Hewitt took home to his wife, but he brought i.t back. within a day or. two, stating that the rental during, the tease was £3 per week, and not 225.; this claim was later reduced to £2 per per week. He had paid into Court, by consent, the 22s per week. The defence was that there was no agreement that plaintiff should be paid for the work specified, he being allowed a house for his family, and the use of the buildings, etc. After lengthy evidence, His Worship gave judgment in favour of plaintiff for the full amount, .whom, he said, had,done the work at a reasonable charge. ■
