TRACTION ENGINE DISPUTE
IS IT A MOTOR- VEHICLE?

The Magistrate (Mr Watson) reserved judgment in- a c«ase the. result of which will be/ awaited with, interest by local bodies. The question to be decided is whether or not a traction engine is classed as a motor vehicle. Defendant operated a. traction engine on a highway without the consent of the Rangitikei County Council in'contravention of the heavy- motor vehicles regulations, 1932, regulation 8, su i-sec-tion 1. Counsel for' defendant argued that consent was unnecessary, submitting that the regulation in (question was ultra vires of the Government-Gen-erals powers, and that a traction engine was not a motor vehicle. The traffic inspector argued that a traction engine is liable to a certain annual registration fee, indicating that that required of it in its capacity as a motor vehicle.
