WARDENS COURT

HOKITIKA SITTING TO-DAY.

Additional Warden’s Court suits were heard before Mr W. Meldrurn. this afternoon. At the last sitting of this Court-, Cecil George Farrow proceeded against Art’llur James Willmot. Plaintiff claimed a declaration . that the claim is held by the partners on equal shares; that defendant- be ordered to account for ail moneys received from gold sold; that accounts to be taken in con-' nection with,The sgid partnership; an order dissolving the partnership; and costs.

Giving'judgment this mornjng the Warden made an order for the dissolution of the partnership, and ordered that accounts be taken before the Mining Registrar. J. -S. Langford \Mr Murdoch) 1 v. C. A. Jolley (Mr Elcook). Mr JElepck said that defendant had occupied an area, oyer which there was a prior title, of which he was unaware. Counsel agreed to. judgment for forfeiture, but asked the Warden not to, grantcosts, which Mr Murdoch ..claimed. Costs were allowed plaintiff.

Constable McLennan said he -found defendants in the bar parlour. One said he had come there to use the tele, phone, and after using it, said he intended staying the night, which was. alot carried out. The second defendant had said he was there to see the otherOne ,of the defendants said h e was a boarder at the hotel that night. • The Sergeant; You will affirm, that even though the licensee denies it?— Yes. I made my arrangemeiit 6 with the barman.

The other defendant said he had gone to see the first defendant, knowing the later to be a boarder. His business was with the latter and 'Mr Keenan, the -last named having -been communicated with by telephone. 'Michael Keenan confirmed the chief evidence of''both, defendants. . . Constable McLennan said th e licensee had denied that defendant stopped at the hotel over night.

Arthur Nanceldvell, licensee of the Railway Hotel, said lie saw both 01 the men on the premises, hut could not say.whether or not one .of them had Stayed the night-. The Sbafnian ’ was authorised to book any guests if necessary. Witness had informed the police on the night in question that defendant had not booked in.

Walter Henry Haybittle .said that defendant had booked with him just after lunch. The Magistrate dismissed the case.
