Litigation 'concerning the custody of a ibaby daughter of AD's Janet M ,,ai y Tale, of New Zealand, Juki an abrupt ending in, the Supreme Court before -'Justice Long dunes. The ■child was ■brought here ■ aboard the Wynganella on Tuesday by the mother, who was taking her to England in -Saturday’s liner.
The father is now coming from New Zealand and desired to prevent t»e mother -having custody and instructed a Sydney solicitor to -apply for a wrR of habeas corpus’.
•During the proceedings an effort was made to compel the mother to enter the witness box, .but the judge de- ■ dined, and Mrs To ha left the court. During argument wi.h her solicitor, the judge said he saw no reason why she should not leave, and no reason why she should be. used to prove the case for the other side. The judge also hinted that' legislation was now before Parliament to alter cases such a§ tins, whereby a husband is the sole custodian at law. The habeas corpus was refused.
