Reserved judgement was given yesterday by Mr Justice Reed in connection with the case <>f Smith and Holling, which was heard at Greymoutli on March I last, when the jury awarded £1236 damages to the plaintiff. The plaintiff was William Ernest Smith, miner, Rumania, -and the defendant Frank Holling, yardman, Ngahere. Mr Justice Reed presided at the hearing. After the verdict defendant’s counsel moved for a non-suit, or, alternatively for a new trial, on the ground that the jury’s verdict was so defective that judgment could not be entered for plaintiff. The case was adjourned to Wellington, where argument was taken on Thursday last. Judgment was given to plaintiff for £1236 7s. with costs according to scale abursoments and witnesses’ expenses and costs of interlocutory proceedings, to be ascertained by the Registrar.

The death occurred suddenly at his home, Lord Street, Greymcuth yesterterday of Walter Cressy, single, aged 35 years. Deceased had been a member of the Waterside Workers’ Union at GreymoutH. He was a native of Ahaura and is survived bv his mother, Mrs Catherine Cresscv, three brothers, Arthur and John of Greymouth, and Thomas of Stillwater; and two sisters, Airs Williams, and Airs J. Brown of Greymouth.

For the week which ended at noon on Monday where was an increase of three case as compared with the number reported the previous week, in the Canterbury district, as follows:—Scarlet fever, five; diphtheria-, three; tuberculosis, four; total, 12. There were reported three deaths from' tuberculosis in fjhe jC'anterbury district, and one death from the same disease in the West Coast district.

The Hon J. Bitchener, Minister cf Public Works has replied to Mr J. O’Brien, M.P., as follows: With reference to the representations which were made on the 28th ultimo at Kumara by a deputation from the Kumara Borough Council relative to the Awatuna—Flowery Creek road being adopted as a main highway, I wish to advise that I have communicated with the Main Highways Board concerning the proposal. The Board informs me that while it has indicated its policy in respect of the proposed connection of Flowery Creek, there is no intention at present to carry out construction work on this section as all available funds are required for the immediate needs of existing highways. The Board states further that in any case it does not contemplate revoking any highway through the Kumara Borough and the maintenance of these roads is being provided for as far as its limited funds will allow.”
