Aidsing out of the level crossing accident at Daves Street on May 2, Archibald Walker driver of the car struck, was charged with attempting to cross the track when the line was not clear, and failing to keep a vigilant look out. Both AValker and his wife were injured and the car considerably damaged. Defendant pleaded not guilty His explanation was that he heard the whistle of what he took to be a shunting train and when almost on the line he heard another, whistle, but saw the train that, struck him too late. Mr Page S. M., convicted Walker, saying ft seemed to*, him the. engine must have been in view'of- Walker had he kept, au adequate, look out, In view that Walker had already suffered considerable loss, it was not, a ease for heavy, .penalty and he‘ ordered’pay-> went of costs £2 11s. ’ t ;
