AUCKLAND, June 23
The hearing of legal argument to Fi-iuTg action against the Crown, was pontinued this morning. Counsel for suppliant said Finn was not entitled to payment, in respect of his office, because lie was dismissed from, it, but he was entitled to damages. Mr Meredith for the Crown, argued that Finn’s office had been abolished by an .amendment of the act of 1931, ■which set up a different board. Justice Reed ; Must I not assume that Parliament would not deliberately Hre?.k a Contrast, without -providing compensation fo r tho person set aside-. Can you find any English case in which a person .has been deprived of office without compensation. Mr -Meredith said he could not, but there was the Canadian case and there was English authority for saying that such a matter -as th’g should not be •dealt with by .a court of law, but by petition to the Government. The Crown contended there was no contract. (Proceeding).
