Judgment/ for the de.bndant was given by Mi* Page, S.M-., in the Magistrate’s Court to-day, in the action for £75 damages, ■ brought' by Capt. F; G. Graham, of Petone, against :• Timothy C. Leadbetter, a horse r trainer\;.:and owner, of Petone. Allegations;, : ;were made by tile plaintiff that the stable boy in the employ of defendant had ■thrown , a stone at an Airedale' b'itfeh,“Aleg Alerrilecs,” and injured her, causing premature whelping death ot five of her litter shortly a ter birth, and the subsequent death of the bitch. The Magistrate considered that assuming that it were established that the bitch had been (struck . by the stone, the weight of evidence and ! ,the probability was that her subsequent death’ v r as due not' to that incident * ...... ' but to Hie lack of proper attention during and subsequent to her whelping. The plaintiff had not shown that any act of the defendant’s servants hail caused or contributed to the birth’s death, or to loss of her pups, and the claim must H : her t efore:.faiJ,; ,
