“Avoirdupois has .nothing to; do .’with the weight of evidence,” declared Mr Justice Blair in the Supreme Court this morning. The question of the acceptance of evidence by magistrates; had cropped up and his Honour .quoted: a case in which he had appeared as; counsel for the defence.
The case was one where a footballer had been charged with using obscene language to a railway guard, said Mr .Justice"'Blair, 'Jjhe , (defeiudunb.. had pleaded not guilty and in Im, supportthe' rest of the numibers. of a football team were called, but. the magistrate, believed the evidence- of .the guard. ■
( ‘And somehow I think -the magis> trate 'was right,” added his Honor jocularly. . , . .• _ ' Mr Sargent, appearing as counsel in the case being heard, remarked that he had recently appeared in a licensing case wketre footballers and four licilieetfillh' wore concerned. >ln - that, instance the magistrate had believed thg footballers.
