CLAIM FOR £448. (per Press Association —■ Copyright.l TIMAIIU, January 25. In the Magistrate’s Court William Paterson claimed' £448 Is 6d : from Aubrey Counsel Stephens and. John, Edward Wheeler, as executors of the estate of John Albert Ainge, of Dunedin, deceased, for money lent. THie plaintiff stated that the money was a personal loan to Ainge, but the receipt was signed by the deceased on behalf of the firm of J. A. Ainge and Co. It was stated in evidence that toe firm was bankrupt, with a deficiency of £15,000, but the private estate had a surplus of £SOO, subject to a contingent liability. After Ainge’s death the plaintiff was advised by the executors that the j, c i,.i m would be treated as against the firm, and the action was brought to decicla 'who was j(o.<fponsible for tß© c>bt.
