LADY HUNTER SUED

'REGARDING PURCHASE OF PIANO. JUDGE RESERVES HIS DECISION. WELLINGTON, October 18. Action was taken in the Magistrate’s Court by the Bristol Piano Company, Ltd., against Lady Hunter, widow o' Sir George Hunter, and Cyril Paul Hunter, as executor of Sir George Hunters will. The claim was one for £94 Os Bd, the balance, with interest, owing on the sale of a piano under a hire-pur-chase agreement. Mr T. B. McNeil, S.'M.. non-suited plaintiffs against Cyril Hunter, and reserved his decision ii. the claim against Lady Hunter.

According to the evidence, the hirepurchase agreement had been -signed by Lady Hunter in March, 1930. The deposit and four succeeding monthly instalments were paid by cheque. Correspondence subsequently took place -and Lady Hunter called upon the company in September, 1931, and asked for the account for the balance to be rendered to Sir George Hunter’s estate. When the Magistrate had non-suited plaintiffs in their claim again-’t Cyril Hunter, counsel for L a dy Hunter submitted that in signing the agreement Lady Hunter had acted as Sir George Hunter’s agent, and that Sir George Hunter was the undisclosed principal. He said also that plaintiff had elected to treat Sir George Hunter as principal. Evidence in suport of this was given by Lady Hunter.
