FRAUD ALLEGED
SYDNEY TIVQU THEATRE CASE. (Australian Press Association.) SYDNEY, September 28. In the case regarding the Tivoli Theatre, in. which fraud allegations .were fuede against three well-known men, ihe Magistrate, after a lengthy hearing, acquitted and discharged the three defendants', Hugh D. Mclntosh, Covell, and Curt*. The Magistrate said .that although single transactions in question, might Fave been suspicious, h e did not cm .rider that fraud had been made c at. Therefore he held there were no cases to answer. Further, the minor charges would a l so be dismissed.
Mr Maughan, K.C., who conducted the prosecution, eaid that th e case was a tragic one for him, 'since a leading fellow barrister and friend happened to be one of the defendants.
