Witness saw the accused that night in witness’ house. Witness ask id the accused to tell him . the truth about what. had happened. The accus d replied: “You have'no need to. worry 1 They will take me.” The accused explained to witness that Wogan had , ; be in sitting oil the bed. Replying to witness explained that the accused had told'him that, before'hb loft the room, He lin'd been showing Wogan How to load and unload the rifle. ' ■Y. .- . i ,;7
Estella Boucher gave levidenoe on similar lines to what she gave in the lower Court regarding the deceased ahd acciis'd’s racing activities. Witne is . stated that the accused, at first; told her that the deceased was standihg' by the door when the shot was fired, and labor on said the deceased was sitting on a settee, >
Jessie Duncan stated that the accused told her that the deceased was sitting on a chair, and that the r’fle was on the Sdttee as he .(accused) left the room.
. Several other witnesses gave similar evidence to that given in the lower coriirt., 1 .. i . ■ The longest evidence was given by Lera’ie Fraser Tiedall, , gunsmith. In the course of cross-examination, he said jt would he possible to shcot oneself from .a - ' distance 7; with a . riflte, providing that tbe.triggjir was fired' by a flail! in. the " wall,! or somewhefe; The shell (produced) bad heefl trodden on. It apparently had beten squeezed towards an oval' shape. “Is that the mark/of tfe nail of a boot on the' (hell ?” counsel asked./
