In' the General Mortgage Corporation, v ' was made Co the Court of Appeal for conditional leave to appeal to ti.ie Privy Council from the judgment of the Court of Appeal, upholding the decision of the Supreme Court in favour of the present respondents dr.ivercd last year. At the hearing the Court of Appeal was equally divided and no cos':s were allowed to either party. Conditional ileave waif granted to appellant to appeal to the tPrivy Council, the order being subject to the three cases going forward as on e and upon the undertaking of counsel for .appellant that he would not apply for nor take more than one set of costs even though more than one may’ be granted.. Security for £4OO is to be given within three months. Ap .application for leav e to appeal to the Privy Council in the case of the iSaracen Shoe Company v. the Minuter for Customs was di-missed by consent.
