APPLICATION DISMISSED. (By Telegraph—Per Press Association) AUCKLAND, February 22. Justice Smith, in a reserved judgment to-day, dismissed an application made by mortgagors under the Mortgagors Relief Act. The applicant .admitted that no notice bad been given to him by the mortgagee. Th 0 Judge said that if the mortgagor could make such an originating application. then (>very mortgagor farmer in the Dominion could make an application for the reduction of interest, notwithstanding that the mortgagee bad given no notice of Ids intention. The giving of mortgagees notice was a condition precedent to the making of a mortgagor’s application. As no such notice was given in the present case, the court had no jurisdiction. Costs C2 2s were allowed against the applicant .
