NGINGONGINGO CASE
OWNER’S MOVE

CHRISTCHURCH, December 14
Notice has bean served on the Auckland Trotting Club by R. M. Morten, owner of the trotting horse Ngingongingo, which is intended to have the effect of an injunction, restraining the Club from paying over the stakes in the Labour Day Handicap, after which Ngingongingo, after winning the race, was disqualified by the Club.
The Trotting Board reversed the Auckland Club’s decision, and the case then went to the Appeal Judges, who, in turn, reversed the Trotting Board’s decision, and sustained the finding of the -Club. •; .The case can now go to the Trotting Conference, and may even go to the Law Courts.
It is understood that one of the grounds of Morten’s action is that the Appeal’ Judges heard fresh evidence without calling the owner of the horse,
