CIVIL ACTION

CLAIM BY LYTTELTON COUNCIL. CHRISTCHURCH, Nov. 24. Reserved judgment was given by Mr H. P. Lawry, S.M. yesterday in a civil action in which the Lyttelton Borough Council sought to recover the sum of £159 9s 8d from Alexander Ait ken, of 80 Dean street, St. Albans, a retired.manager; William H. Robinson, of 17 Bishop street, St. Albans, a savvmiller; William Hahn, of Sherwood, a mill manager, formerly carrying on business under the style or firmiOf the Sherwood Sawmilling Company7"and Sherwood Sawmills, Ltd., a company duly incorporated and having its registered office at 89 Jeffrey’s road, Bryndwr, and carrying on business as a timber milling company.

;< The amount claimed was alleged to be royalty on trees purchased for milling purposes at Sherwood reserve and at Urrall i Reserve at different rates computed om timber cut and removed in July, August, September, and. October of 1930. Following an adjournment of the hearing, the name of Margaret Rbbin®on, the wife of one of the defendants, W. H. Robinson, was substituted in the place of his name. The judgment stated that when the defendants, Aitlcen, Margaret Robinson, and Hahn were in partnership they had entered into an agreement with the ..plaintiffs, who agreed to sell to them for milling purposes trees at Sherwood and at tJrrall reserves. In June, 1930, the partners in the company sold their interests in the partnership to a limited company which they had formed, called the Sherwood Sawmills, Limit-43. J" The litigation concerned the liability of the new company to honour the contract- entered into by the former partners. .Judgment was given for plaintiff tor £159 9s 8d against Aitken, Margaret Robinson, and Hahn, and for the defendant company, Sherwood Sawmills, Limited, for costs.
