INTERESTING WILL CASE.
A reserved judgment of His Honour, Mr Justice Adams in the Will Case, heard at Greymouth last month, was read by the Registrar this morning. Application was made for probate of the will of James O’Brien, late or Maori Gully, miner, by his nieces, Misses Fitzpatrick of Wallsend., The grant was opposed by the Public Trustee and also by a nephew 01 the deceased, resident in Ireland on the ground of testamentary incapacity and of undue influence.
In his written judgment His Honor held against the objectors on both grounds and granted probate to Miss Fitzpatrick, the executrix mentioned—oil the last will and allowed costs amounting to 30 guineas to Counsel for Miss Fitzpatrick. The estate consists of the sum of .£I,BOO fixed deposits in the Bank at Greymouth. Mr J. A. Murdoch (with him Mr J. \V. Hannan) appeared for Miss Fitzpatrick, Mr Bros nan for Mrs Murphy, sister of the deceased and Mr F. A. Kitchingham for the nephew the cav eator, and the Public Trustee.
