He was charged .with ha.ing negligently driven a motor car s'-as-to cause the death of Harry Levitt Parker, on June 8...4,.The 'case out of a fatal accident,, which occur red about midnight on June 8, in New North Road, at the corner of Porter’Avenue. Deceasd wa.s a passenger in the front seat of the car driven by the accused. h-.
In summing up, Justice Herd mac said that the accused had been unde the influence of liquor, and that- if war impossible ifor him to have exercise: proper control of- the motor car. It was absurd to say that because a ma. had one drink, or more than on drink his judgment had become cloud ed, or because'"his breath smelt of al coliol- to sav that he was incapabl • of controlling a. motor car ; hut if it had been proved that the nrn had so indulged that he had reached the paint when he was incapable of con tolling the car, he Was guilty of neglect.
