£SOOO CLAIM. OVER MOTOR FATALITY. < liy Telegraph —-Per Press Association) Till ARC, July 30. In the Supreme Court, Helen A. Revel! claimed ToUOU compensation from David Herman August, carpenter of Christchurch, as the result of the death of her husband through his being knocked down by a car driven by the. defendant Th Tinniru on March lb last. The evidence of tlie plaintiff was to thi> effect that the defendant had ample opportunity to avoid the accident. Witnesses for the plaintiff stated that the deceased crossed the road without looking lor traffic. He stopped suddenly, took a stop forward- then hack, slipped and fell, the car going over him. Witnesses also asserted that the accident- was due to the deceased hesitating. Counsel for the defence, at the conclusion of the plaintiff's case, applied for a non suit. The- judge agreed that there had been contributory negligence, withdrawing the case from the jury.
