COMPENSATION CLAIM

JUDGMENT FOR INSURANCE COMPANY. WELLINGTON, December 2Reserved decision was given by Mr Page, S.M., in the case in which George Thomas Maslem proceeded against the London and Lancashire Fire Insurance Company for additional compensation which plaintiff considered due to him under an accident and sickness policy taken out with the company. The Magistrate stated that under the policy it provided that plaintiff should receive insurance money should he be rendered totally unable to attend to business of any kind and- be necessarily and continuously confined to bis house. As a result, inter alia, of nontubereular pneumonia, plaintiff contracted pneumonia, and as a result his heart was affected. He had been paid full compensation for a certain time and part compensation for a further four weeks, but he claimed full compensation for the full time of his illness.

The Magistrate held that the evidence fell short of establishing that plaintiff was totally unable to attend to business of any kind and bad been continuously confined to his house, as there were periods when he went to Auckland for a change and on a motor trip to Wanganui. Mr Page therefore entered judgment for the defendant company with cost.
