WELLINGTON, November 28
An application was made in the Supreme Court to-day to Justice Ostler for an increase in the allowance made under her husband’s will to Mary Mackln, the widow of the late Dr. Patrick Mackin. of Wellington. The ground on which the applicatoin was made was that the provision for the plaintiff’s maintenance was inadequate, having regard to the value of the estate and other circumstances. The value of the estate, after the payment of the death and succession duties and other outgoings, was about €34.000. A fund of £17,000 was set aside to provide an annuity for the plaintiff’s maintenance during her lifetime, and thereafter £12,000 would go to various charities, leaving £SOOO to fall into the residue.
According to an affidavit filed by ’the Public Trustee, the executor of the
estate, the legacies given under the will totalled £16.000. the greater part of which were to her absorbed by charities. The testator gave the residuary estate to the Bishop of Down and Connor, Ireland, and other substantial benefits to the Parish Priest of Kilkeel, Ireland.
The widow received the sum of CIOOO an dnlso furniture valued at £270. in "d-dition to the interest in the fund a l ' £17.000; thus giving her about £B4O per year.
