BREWERS’ LICENSE APPEAL

APPEAL COURT DECISION. N WELLINGTON, Oct. 24. The. Court of Appeal delivered .judgment in the case of Jorgensen versus Minister of Customs, telegraphed on October 9th. Chief Justice Myers held that although the questions raised in the originating summons could not Inanswered cat-egoi ically, the legal position could bo summed up in the following answers: — 1. The Minister had not under the Finance Act, 1915, the absolute right to refuse a grant of a brewers license. 2. —lf the application for a brewers license were made and a brewery and plant erected in accordance with the statutory requirements, and not erected in a no-license area, the Minister must grant his approval, unless lie refused cm the ground that the applicant was not of good ..character and reputation,* and therefore unfitted to hold a. license. 3. The Minister had not unfettered discretion to refuse an application for a brewers license, for his powers were limited as set. out in the Act itself. 4. Where the Minister under the Finanee Ac-t*. 191/, refuses his approval u> the issue of a new license on the grounds of character of applicant. anch an applicant has the right of appeal, as contained in the Act. No order was made as to costs.
