FIREMEN AT THEATRES
TEST OF BOROUGH BYE-LAW. *.

WAIROA, September 4. A case of much interest to pictured" proprietors was heard, at the Magistrate's Court here this afternoon, when the Borough Council proceeded, against the Wairoa Amusements Coy. for a breach of the bye-law requiring, theatres to employ firemen at a charge of 3s 4d per evening’s performance. Mr Chamberlain, Jor me ■council, said that the bye-law was similar to that of many other local bodies, and was within the terms of the Corporations Act. *"^J. Mr Barnard, for the defence, mitted that the Fire Brigade Act removed the power of making bye-laws - providing against the danger ol hrt, and constituted the Fire Board as the sole authority with power to make bye-laws providing against fire. The presence of a fireman was useless to prevent fire, and the danger of panic was best provided against by the theatre staff having control. The introduction of a fireman merely meant dual control. Ml* Harper, S.M., said the case was one of Much, importance, and he reserved his 'decision.
