JUDGE’S COMMENT
“NOT A DEBT COLLECTING INSTITUTION. ’' AUCKLAND, Aug. 29. “The Bankruptcy Court is not a debt collecting institution,” said Air Justice Herdman a.t a sitting of the Supreme Court this morning when asked to grant a further adjournment of a summons against a debtor. Hiu Honour’s remark was prompted by counsel’s explanation that the debtor had .made a payment since the summons was adjourned at . a previous: sitting of the Court and that there wap a prospect of a full settlement. The debtor was 11. H. Adams, mining engineer, of Grey Lynn, who was at present in a. remote part of the Coromandel Peninsula. Since the previous adjournment his agent had paid £SO on hie behalf. Mr Grant, who represented the petitioning creditor, said that the total debt was £250, owing on a motor car which was being held by the debtor and creditor for sale. “I don’t like to make a man bankrupt if he has a chance of keeping out of the Bankruptcy Court,” commented his Honour, In granting an adjournment for one week he added: “Tell him he had better come here. If he does not come I will make him a bankrupt,”
