Following further evidence the Coroner returned a verdict that deceased came to his death at Wallsend on February Ist. through accidentally falling under a passing railway train. Detective Murch prosecuted, and accused was represented by Mr W. J. Joyce. After hearing the evidence, the Magistrate Mr Meldrum said the point he had to decide was whether there was sufficient evidence that accused broke and entered Perotti’s house with intent to commit the crime of theft, There was no evidence found on accused to support the charge that he intended to commit theft, and he did not think a jury would convict accused on the evidence. He. certainly went into a house he had no right to enter, but- unless he had the intention of committing theft, he was not guilty of a. crime. He was guilty of a civil trespass. There was at least a doubt about the matter, and accused was.entitled to the benefit of mat. He did not think, concluded the S.M. that he would be justified in putting the country to the expense o! committing accused for trial, and the case would 1 therefore be dismissed.
