aviator CONVICTED, v (By Telegraph—Press Association). TIMARTJ, Sept. 9. On a charge, that within view of a public road at Timaru on Sunday, August 25th. he worked at his calling by taking passengers for a flight in an aeroplane for payment, William Henry Lett, who represents the Goodwin Chichester Aviation Coy., has been convicted witnout penalty. The Magistrate, Mr C. R. Orr-Wal-Ker, in giving a reserved judgment to-day, said that the defendant claimed exemption from the Poire OfFenees Act, Sub-Section 30, of Section 18 of which provided that every person was liable to a fine of £5, who on Sunday worked at his calling in view of the public. There were many exemptions, continued the Magistrate, but the onlv one which rould apply to defendant, read: “Nothing in the foregoing provisions shall applv to persons driving any public or private motor carriage or cab.” The defendant contended that in an aeroplane fitted np for the carriage of n person or of persons, was either a motor car or a carriage within the meaning of this exemption. Tn the ordinary s°ii'c of the word, a motor car. in the Magistrate’s opinion did not include an a cool atm. nor could the word carriage “be held to mean an aoron’ane.” “Therefore T must hold that tlm defendant dues not eome within the exemption ns claimed.” The Magistrate added: “As this i« the onlv question I have to decide, a conviction will he entered, hut as it has been customary for aviafors to take passengers for flights on Sunday for reward, apparently without objection by the authorities, there will be no penalty.
