(By Telegraph—Press Association)

AUCKLAND, Sept. 4

Allien William Thomas Youlden walked out of Mount Eden Prison this norning after serving three months’ sentence for unlawful conversion of a motor car, he was met by a detective, who arrested him. Later Youlden appeared at the Police Court on the following charge: That on May 21st. ■1929, being a person the date of whose arrival was earlier than two years after the termination of imprisonment suffered by^him in respect of an offence which, if committed in New Zealand, would be punishable by imprisonment for two years ’or upwards, not being a mere political offence, and no pardon having been granted, he did land in New Zealand. The Collector of Customs, who prosecuted, said that Youlden on August 7th. 1928, was sentenced to twelve months imprisonment at Adelaide,, Australia, for attempted lnrcency from the person. He came to New Zealand on May 21st. under the name of Thomas, and shortly afterwards he unlawfully converted a motor car, which earned him a sentence of three months’ imprisonment. -Because of his arrival in May, lie came within the immigration restriction act, and was therefore a prohibited immigrant. The Collector allied for an order to deport Youlden to Australia.

“I know that the police will object to it, but could 1 have bail,” asked Youlden. He told the. Magistrate that he intended going to Australia of his own accord, and he asked if he could have his liberty until the boat sailed. “You have got a very bad list. I think you will be safer inside until the boat sails.” Bail was refused.
