In the appeal case, If. 1). James 'printer, of Greymoutli) versus E. B. -' taLi n (ex-banker, of Nelson) heard on .March 21st, tlio Court of Appeal allowed the appeal. After dealing with the principles upon which the ease* should he decided the judgment concluded; “Without expressing any opinion erne way or another on the claim lor relief, we 'cave-that phase of the litigation and content ourselves by staling that an examination of the statement erf claim ins failed to satisfy us that any plain, obvious reason exists for interfering with the litigation between Llic; parties at this stage.
The appeal is therefore allowed with costs on tin' highest scale as from a distance.
The judges were Acting-Chief Justice Herclman and Justices McGregor and Ostler.
At the hearing .Messrs J. A. Murloeli and H. F. Doogan appeared if or i he appellant and .Messrs M. M.vcrs, N.C., and if. F. Ward for the respondent.
