COLLISION CHARGE

(Received this day at 11.25. a.m.) MELBOURNE. April 23.

At the hearing of the charge against Herbert Vincent, third officer of the steamer Kaituna, that lie failed in lii.s duty and disregarded collision regulations on the night of 29th. March, a novel point was raised for the defence. A collision occurred between the Kaituna and Norwegian steamer Scljo, the latter sinking immediately, and the Kaituna badly damaged her hows. The Marine Court inquiry found the Kaituna to blame, her master (Capt. Sizer) and the third officer being held responsible. Vincent’s counsel now points out that a passage in the Marine Court’s finding. incorporated in the statement ol facts, presented in this ease, dealt with the courses of the two ships and the effect was that one of them passed over dry land, inland from Cape Neilson. The Court deferred consideration.
