Af (he Supreme Court, a judgment was sc! aside tn-da.v h.v Judge Adams, and dered a new trial, on the ground tlnu the jury’s finding on the third issue submitted to if was against the weight of evidence. Tlie case was heard in Timarii when William Anderson sued John l ndcrhill for damages as the result oi a collision between the former’s motor cycle and Underhill’s delivery van. The jury awarded Anderson C 330 special damages and £3OO general damages, holding Underhill had been guity ol negligence. On the third issue the jury held the plaintiff was not guilty ol negligence.
