DAMAGES CLAIM FAILS. (By Telegraph—l’.or Press Association.), HAMILTON, Sept. 24, A claim for £1895 damages for injuries received in an accident on the Wnipa Collerie’s private Railway was brought before Mr Justice Blair at the Supremo Court, by Fedcriek Geurgo Herbert, a labourer. Tho aolcident happened last November, A trolley manned by Herbert and John Chandler Hill plunged over a viaduct after a collision with another trolly Both men were seriously injured. Hill .since committed suicide.
Judgement was given for the defendant colliery company to-day on tin ground that Herbert failed to keep proper control of the trolley. This does not affect his claim under the compensation law, which will he considered.
