OFF-SIDE RULE. DOES NOT LESSEN DUTY OF DRIVER. (By Telegraph—Per Press Association.) AUCKLAND, August 28. In giving reserved decision and dismissing an appeal by- Victor Milton Simpson from the judgement of ADM’Kean, S.M., who found for L. C. Watson in an action for damages, consequent on alleged negligent driving of a motor-car, his Honour referred to the offside rule which formed part of the basis of applicant’s case.

His Honour said that it was an excellent rule to regulate traffic, hut was no defence whatever to a negligent driver. He disagreed with the contention that the judgement of Mr Justice Ostler placed a different construction on the rule. Air Justice Ostler had decided that special precaution must be taken by tbe driver of a vehicle debouching from a side road on to tbe main road, as if be did not and an accident occurred lie would be guilty of contributory negligence which might disentitle him to recover, even though the driver on the main road was driving negligently. The rule in no waylessened the duty of a driver, whether on the main road or side road, to take responsible care. MEAT PRODUCERS. WELLINGTON, Aug. 30.
