(By Telegraph— Per Press Association SALE OF A PRACTICE. AUCKLAND, Dec. 8.

The claim by Dr William Arthur Alexander and his wife, against Dr Ernest James Millar for £2OO damages for alleged fraudulent misrepresentation. was continued at the Superme Court to-day. Further evidence was given for plaintiff. In opening the case for the defence, Mr Richmond said the allegation was that Dr Millar had shown average annual earnings amounting to £4160, where as they really were £IOO2. Obviously, most of that had gone hv the board, for an accountant had shown average earnings of £1216 from the books. Plaintiff had not investigated the books, and had proved nothing. It was rnonstruos to suggest that Dr Millar would engineer a gross fraud for years, and then hand over to Dr Alexander the hooks from which any Fourth Form boy could expose the position in a few minutes. Dr Millar had submitted nothing hut the truth. His hank books showed payments of between 9700 and £BOO a year into the bank, and, in addition. Dr Millar paid all household and current expenses, amounting to upwards of £6OO a year, out of cash not put through the hank. The position was that Dr Millar was not anxious to sell, and named his price, and Dr Alexander could take it or leave it. The defence evidence was not completed when the Court rose for the dav.

The Chairman of Tongariro National Park Board states Hie Board will acquire several line scenic reserves alongside the main trunk railway under the Empowering Act passed last session. These will increase the Board’s area by fifteen to eighteen thousand acres. The Chairman also stated the Board had received a. donation of five hundred sterling from the trustees of the Bruce estate, towards the erection of a proposed new hostel on tlie Park.

IMPRLSONMENT IMPOSED. GISBORNE, Dec. 9. Three months imprisonment sentence was passed by Air Bevvy, S.M., to-day on Israel Gollior, who had pleaded guilty to breaches of the Bankruptcy Act. AMATEUR ATHLETICS. CHRISTCHURCH, Dec. 9. Glorious weather prevails for the fiist day of the New Zealand Amateur Athletic Championships at Lancaster Park. In the AVright-'Morgan case counsel for plaintiff, with the consent of other counsel, asked for an adjournment till Monday to enable a conference to he held, with a view to a settlement of not merely the present litigation, hut of nil the threatened litigation arising out of the Wright estate. The adjournment was granted.

CHARGE DISMISSED. GISBORNE, Dec. 9. The Magistrate dismissed an inlormation against a service car driver, Cecil John Brennan, alleging he was intoxicated while in charge of a car concerned in a recent accident at Ruatoria.

TIAIBER. AIILL FIRE, A HEAVY LOSS. AUCKLAND, Dec. 9. A fire early this morning destroyed Henderson and Pollard’s timber mill and factory near ATount Eden railway station. Four fire brigades were engaged in saving the adjoining premises, some of which were slightly damaged. The fire swept away buildings covering half an acre, and the Company’s loss is estimated between eighty to hundred thousand pounds.

Police Sergeant Flannigan was an atoned at 4.45 by a lire crackling and found the sash department on the ground floor ablaze. Aloilnt Edeti Brigade was promptly on the spot followed by the City and other Brigades. As the first hose was run out. the heat was so intense that the hose was burned through and throughout the firemen had a most strenuous time, whife huge stacks of timber went up in smoke and flames. For hours’ continuous streams of water were poured on the burning mass.

At 11 o’clock the fire was still burning fiercely. In addition to Henderson and Pollard’s loss, the Kauri Timber Company’s premises, adjoining, were damaged to about four thousand The premises of Henderson and Pollard, are covered by insurances in Lloyds, but the amount is not availaide. As the result of the fire alxiut one hundred men are thrown out of employment, pounds ANOTHER. FIRE. TAUAIAR ANUI, Doc. 9. About fire o’clock this morning, a fire broke out in AVinstone’s Roofing, Brick and Tile AA’orks. The blaze was located in the tile drying rooms. The Brigade made an excellent save and bad it under control in half an hour. Considerable damage was done to the building and machinery. Insurances are unavailable
