APPEAL ALLOWED. SUPREME COURT ACTION. WELLINGTON. June 27. An appeal from the decision of Mr W. d. Riddell. S.M.. was heard lnMr Justice Ostler in the Supremo Court to-day. Henry Hastings ScaInook. of Am klaiid. teas the appellant and the respondent was Thomas John 1.. Buxton. aeeomitaiit. ’Wellington. The facts were that Buxton u.is oppointed secretary of a partnership known as the Non .Stick or Crnrk Oiled .Material Syndicate. He alleged that £6O was owing to him asecretary, and that Seitibrook was in terms of Section 3 of the Companies Act. 1008. personally and individually liable for the debts of the partnership.
In his judgment the Magistrate said that it. was argued that the partnership could not contract with Buxton. as such a. (ontraet would he illegal owing to the fact that the partnership consisted <d more than tell persons and was not registered under the Companies Act. The Magistrate
said he did not think this argument was sound as sub-Section 2 ol Section .'i of the Companies Act expressly made all members ol any .such partnership which was not registered under the Act, jointly and severally liable for its whole debts and expressly stated that any such members could he sued for such debts without the joinder of any of the other members. The Magistrate gave judgment for the plaintiff for £lO 13s. The respondent claimed that the judgment was wrong in fact and in law and that the resolutions ol the syndicate were incapable of creating any legal liability on the part- el the defendant.
In giving judgment his Honour referred to a resolution whereby he said Buxton had undertaken the work without promise of remuneration, and he allowed the appeal.

The Directors of the New Zealand Insurance Company Ltd. have decided to recommend to the shareholders at the annual meeting on August 2nd. the payment of a dividend of lid a share for the half year, making a total disbursement for the year of Is 9d per .sic a re. THE DUTY ON TOBACCO. AUCKLAND, June 28. Inquiries among merchants this morning elicited the fact that though there had been large clearances of ondrd spirits, no noticeable quantities t tobacco had been released. W bile there is just a possibility of increased duty, many are of the opinion that the tariff will remain the same. One me reliant even went si fains to predint .a decrease, though this is regarded ns absurd. TXTER-TSTjAXD phone. CHRISTCHURCH, June 28. The inter-island telephone service, which has been completed for some time, was tested on .Sunday between ■Christchurch and Wellington and Auckland, and proved to be entirely satisfactory. The telegraph engineers m the centres conversed for some time and discovered no faults, reception being remarkably clear at each end. A Christchurch telegraph official stated testerday that the service would f>e officially opened within a few days. It had been reported that the official opening would take place yesterday, hut he had received no communication to confirm the .statement.
STOLEN CAR. W T.LLTNGTON. Juno 28. At one thirty, this morning a police constable’s attention was arrested by a car engine racing. Investigations led to the arrest of James Tier and Brian J. Driscoll, watersiders. who wero convicted at the Police Court, of the conversion of the car. and given three months’ imprisonment. On a charge of being intoxicated at the wheel, I ier got another month, concurrent.

DIVORCE GRANTED. CHRISTCHURCH, June 28. Lawrence David Tlarland. master painter, St row,an Road, in the Supremo Court in divorce, before Alt' .1 ustico Adams, petitioned for divorce from Ruby May Harland, on the grounds of desertion for more than three rears.
MOTOR VICTIM. Wellington. June 28, Mrs I’inofold, wife of Rev Dr J. T. Pinofold. Arpthodist minister, of Karori. was knocked down hv a motor cycle and seriously injured opposite the Old Karori Golf Links. Tt. is believed that there is a fracture at the base of the skull. Her condition is serious.
