SUPREME COURT.

SITTINGS AT HOKITIKA. AIOXDAY, AIARCII 15th. AX APPEAL. Michael Treacy v. Alary Neanie, an appeal from the decision of Air H. P. Lawrv, S.AL, in declaring appellant was the father of the child of the rcsponclcnt. Air Joyce appeared for the appellant and Air .Murdock for respondent. AFTERNOON SITTING.

Tlie Court resumed at 2.10 p.m. The hearing of the Treacy—Xeamc appeal was continued. Evidence for the complainant in the original case (Alary Neanie) was given by Alary Neanie (complainant), Frank Neanie (fatber), Henry Neanie, Percy Neanie and Airs Neanie (mother) and for the appellant. Afiehael Treacy by himself, Alary F.leen Griffon. Henry Pugh, All's Alary Pugh and A. T. Surgcnor. At, the conclusion, Air Joyce said he was prepared to leave it to His Honour to judge on facts and Air Alurdocli also agreed, but asked leave to quote a case as to corroboration, which His Honour intimated was not necessary.

His Honour in giving judgment said apart from the new evidence called lie did not think the appellant had shown the ALigistrate to have boon wrong. The question was whether the additional evidence called had been sufficient to make that decision at least doubtful. Referring to the evidence called additional to that placed before tlie Afagistratc, lie bad not been at all satisfied that there was any greater reason to disturb that decision. The witnesses for the appellant did not agree aiming themselves-and in any event their evidence tended to strength, en the possibilities of the complainant's story. He was of the opinion that the complainant or respondent (Alary Neanie) had proved her case. The appeal would therefore lie dismissed with costs, counsels fee £l2 12s with disbursements and witnesses fees, to be, fixed by the Registrar.

This concluded tlie business ol the session and the Court adjourned at C p.m.
