RACING AUREAL. [BY TEIiF.fiHAPU —PER I‘JtESS ASSOCIATION.] I'AL.MERSTO.N N., Dee. 2. In the matter of an appeal by 11. Barr, owner of the horse. Regent, aaginst the disqualification of the lii>r.->c, under Part XXXII, Rule 4, of the Rules of Racing, consequent upon the disqualification tor life of the previous owner, E. E. Lees, by the Auckland District Committee, as from October Ist, 1925, judgment has been delivered as under:—
•• This is a case in which 11. Banstates he took over the horse Regent in settlement of debts owing him by F. E. Lees, the previous owner of the horse. The transaction was dated 21st March, 1925. Lees was some months niter the sale to 11. Barr, disqualified for life for corrupt practices, committed on or about March 17, 192<>. Wc find that on the date of the sale to Harr, that the benefits of Part NXXII, might he disqualified under the Rules of Raicng, hv reason ol corrupt practice cuinniited by Lees. AVe cannot think, in the circumstances admitted liy Barr, that the benefits of Part NXXII, Rule 5, of the Rules of Racing, should be applied to this case. AVe therefore dismiss tho appeal.
