Mr Murdoch for the defendants stated the case had been settled. Case struck out. AX APPEAL. p. Rudoinski v. W. T. Ilaseler, case on appeal from decision of Magistrate: counse! to confer as to evidence omitted from notes of evidence, and to sub mit memorandum. Mr'Murdoch for petitioner. Mr Pilkington lor defendant. Air Murdoch stated that counsel had not Ihcii able to agree as to die ovidemc. lie suggested that the case he further adjourned and that counsel confer with the Magistrate with a view to settling the points in dispute; lading that he could sec no other course than fur the ease to be reheard. Mr Pilkington agreed that this would be the best course to pursue no dm- the circumstanees.

His Honor intimated that lie was unable to hear the ease as it stood. Hailing the suggestion of counsel being given effect to. he suggested that an application he made to Mr Justice Adams, at Christchurch, in re-hour the whole ease at the next sitting. Counsel agreed to this course and His Honor ordered the appeal to stand over till next sitting. This concluded the business mid the Court adjourned.
