[DY TELKQIIAPTI—PER PRESS ABSOWATrwI.] WELLINGTON, duly 2. The- Court of Appeal was engaged this morning in the hearing of motions to strike off from the roll of solicitors. Mr Von Haast, for the Law Society, moved that. Atari in .Joseph O'Hrien he struck off the roll'on the ground of his conviction for forgery and t hoi t. A rule nisi was made absolute aci ordingly. costs being allowed. In re Henry Edward Elliott. Air Von Haast appeared for the Law Society. Afr Blair for AH Elliott, stated that a solicitor was required to have audited a trust account, hut. Elliot had not complied with the statutory requirements. This was his third time before the Appeal Court for offences against the Law Practitioners Act. Elliott has sent a telegram that if the matter was adjourned for one week, he would produce an auditor's certificate. Tf the accounts are in order this would affect, the judgment of the Court. He was struck oft - in 1013 for not producing a certificate from the auditors, re-admit-ted In 1010, and again was in trouble for the same offence.

Sir Robert Stout (Chief Justice) : AH you ask for is an adjournment, to enable him to put the accounts straight. Afr Justice Sim: He has treated the proceedings with contempt and lie filed no affidavits.

Justice Alpers: He is apparently constitutionally unfitted to lie a member of the profession. The case was adjourned for a week. In a case against- Lionet Lancelot Hitclings, counsel for the latter said Hitchings had a brilliant career, but unfortunately he took to drink, and had other misfortunes as well, eventually stealing from the firm which employed him. He was now making a great effort to redeem himself. Decision was reserved.
