Counsel for the defence contended that under the will the option of the estates was assignable and that tbo testator did not regard it as a disability for a trustee to purchase. Counsel said there was only , one breach of trust that could he looked upon as important. That was the giving of a second mortgage. ” 'phe judge: “That seems to be the most serious.” Counsel contended that unless the Court was forced to a disciplinary point of view, the trustees should he allowed to stand.
