At the Supreme Court, before .Air Justice Adams, the ease was heard of A. Motley v. Boiler County Council, notice of motion for amendment of By-law No. LA, relating to lorries, motor ears, motor cycles and limber waggons upon the grounds that certain defects have been discovered and the said by-law should lie amended in the following ways as detailed. Mr A. A. Wilson appeared for plaintiff and Mr A. C. Cottrell for the defendant.
Air Cottrell said tho hy-l.nvs were based on those ill Westland, which were reviewed by the Court ol Appeal. They had amended the by-laws, and lie ibought the amendments might ho acceptable. If not, Air Wilson could offer any objections he had. .Mr Wilson agreed that the decision of the Court of Appeal covered the points raised. His Honour said the parties did not have a copy of that judgment prior to the institution of these proceedings. He thought- the Court had gone as far as it would go in the amendments in the Westland ease. The Court should not be asked to usurp the legislative functions of tho County Council, but lie suggested that counsel for the parties draft amended by-laws, in keeping with the amendments made bv the Court of Appeal, and others that might he agreed to hv tlu* parties concerned. .il.r Maloney asked permission to walch proceedings on belnill ol the ( anterhiirv Automobile Association.
Ilis Honour suggested that Air Moloney might join with the other parties in the conference. Counsel agreed. The conference having been held and lhe results suhmii ted to the Judge, lie I to embody tliein ill an order amending Hu* by-laws to bring them into line with the decision of the Court of Appeal in Westland County ease.
The main ell'ect is. that the fees for moli.r ears, using the county roads, are m.w slightlv reduced to make them fair and reasonable; and the periods for which licenses ran he taken out are reduced to 1, .'i, f! and f> months instead of being <; and 12 months only, the fees being reduced accordingly.
