Capes, and Alfred Tucker were charged at the Supreme Court with conspiring to defraud Otalmhu Trotting Club by .substituting an unkijown horse for All Smoke. There were four counts including two
of attempting to obtain money from the Club. Bleas of not guilty were entered. It is exported the trial of all ilm eases "ill last a week.
