The evidence tendered ill the eighth charge, addresses were delivered by Counsel for accused and tlie prosecutor, at Mm conclusion of which the ninth charge commenced, in which it is alleged that Lieut. Crampton permitted unnecessary force to bo used to compel Private Badger to drill. Giving evidence, Private Badger deposed that he was kicked by Sergeant Smith. He also was punched. Witness also declared that the accused used had language, and that Crampton also struck him under the waist with a cane during drill. A rifle was strapped to witness’s wrist. To Mr Lauglman—Witness said ho was a conscientious objector. lie bad laid his rifle down because of Iris coiisciontous objections. He hud not complained of any injuries. Accused gave evidence. Ho denied Badger was lacked or punched..
