CHARGE OF MANSLAUGHTER AUCKLAND, August 10,

As a sequel to the death of John Patton, a tramway worker, who was knocked down by a motor car in Kli.vbor Pass on August l2tli. S. Carey and Rupert J. Morris drivers of the two cars involved were charged at the Police Court to-day, with »ianslaimliter. Sergeant Matthews gave evidence that on the way to the morgue Carev said: “Worst of it,-T was o.« my wrong side. There was 9 n obstruction on the other side, and I could not get through. Witness measured the space between the obstruction thrown up hv the tramway gang and the kirbinjr ‘and found if 6} Rot. R was eight yards from the spot where tlm blood stains were, to where it was alleged Carey had turned his ear. Accused said he had passed the obstruction at nine that morning, just missing a man crossing the track. Carey denied that he was travelling at 30 miles an hour. Morris stated that he went on the wrong side of the road because there was a earl on the other side. He did not know there was a car following. Other witnesses stated that they saw two ears travelling nt high I speed in one instance abreast and in the other on the wrong side. One said the first car missed deceased by about a foot. Both accused pleaded not guilty and reserved their defence and were committed for trial.
