Both were miners at Huntly. , Kernohan denied provocation, but admitted Mrs. Harry had visited him j in the hospital throe times a week since the shooting. Accused said he was married six years. He picked up a gun to shoot a troublesome dog and Kernohan rushed him threatening to choke him. The trun exploded He could not remember : pulling the trigger, or what happened afterwards. He claimed that Kerno- ‘ ban misbehaved with his wife. ; The jury returned a verdict of guilty of causing grevious bodily harm ! with a strong recommendation to mercy on account of the state of mind and extreme provocation. The Judge sentenced him to eleven imprisonment. 1 , but said he would recommend to flovernment that prisoner be discharged at once, on condition that he rejoined the forces. Harry had previously enlisted and was accepted for service. > His Honor agreed with the jury that prisoner had no intention of killing and that the shooting was unpremediat©.
