wandering CATTLE.

Borough Inspector (Mr Park) v. W. .Tones, a charge of allowing 6 cows to wander in Tudor street; fined 10s and < osts 7s. AN ADJOURNED CASE. Tooliey Bros (Mr Wells) v. Dr Fleming (Mr Park), a claim for £5; adjourned from last court for evidence of Mr Spiers to he obtained. Mr Park did not present Mr Spiers, but. asked to be allowed to call another witness.

Morris Connolly gave evidence that, bo remembered Mr Toohey going to Otira with Dr Fleming in a motorcycle. Witness was a roadman at Jacksons. Defendant stopped at witness’s house, and called out for parcels. Witness had . none. Asked defendant where Spier was, and the Doefoi said he was' on a trial run. It was a wet day. To Mr Wells.—-Did not take particular notice of what the driver was wearing. It was the usnsfl thing for the doctor to stop. Dr Fleming called about- a week ago, and asked witness if he remembered the day he went through on the motor bike. Mr Wells recalled James Toohey, who totally denied seeing Connolly or stopping at his place. Knew him well. Am absolutely certain they did not stop between Mrs Griff en’s and Otira. Dr Fleming, recalled, deposed that on the day i n question he saw Connolly, and asked him how he was.

The Magistrate—Then that was the second visit made that day. Witness —No! He did not visit Mrs Griffon on the day in question. They stopped two or three minutes talking to Connolly. It was raining at the time. Arrived at Otira wet through. r rhis concluded the evidence. His Worship said he would give judgment at 2 o’clock.
