AN IMPORTANT RULING.
WARDEN HUTCHISON OVERRULED. DECISION OF MILITARY APPEAL BOARD. It will be remembered that at previous sittings of the Military Servico Board, that the question of granting protection of the rights of D. J. Hutchison at Kanieri came up, and that Warden 'Hutchison took exception to tho remarks and attitude of the chairman of the Board (Mr Evans, S.JM-* who took objection to Warden Hutchison’s remarks when dealing with the application by-'D. J. Hutchison of | Kanieri for protection, and- stigmatised the allowing of six months’ protection granted as absolutely useless. This afternoon the adjourned application of D. J. Hutchison (Mr Sellers) [ an appeal on behalf of his son, Arthur Hutchison, cam© up again for hearing before the Military Service Board, i The chairman (Mr Evans, S*M.) said ! this case had been adjourned from time | to time to allow of adequate protection ! being granted over the mining rights j dependent on the work of the appellant while he is serving his country. At I th© last sitting tho Board did not con- ! eider the protection granted anything like adequate, and since then the Gov- ’ ernment has deemed it necessary to give power to Military Service Boards themselves to grant such protection as they think just and adequate m all cases whore the demands of th© Empire [ has made protection necessary. ® , Board) considers that every man called . to serve his country has an absolute right to havo his property protected for him until ho returns, and m the . future will see that he has it before sending him. ' The rights will, therefore, he protected, while the appellant is on aci tire servioep and for a period of 12 months after. If counsel (Mr Sellers i will prepare a schedule of the rights _ will give the necessary certificates. ' - Th© appeal will he dismissed and apft pellant allowed till 21st August-
