UNUSUAL MOTOR OFFENCE

An unusual motor ease in which Samuel DavicV John Cairncross was charged with having xjrocuredi a license to drivte a motor-cycle, being a person who was disqualified from holding a license for two yeais, came up for hearing.

The facts of the ease, as given- by tbe police, were that Cairneross had been, in the Petone Court in August, 1929, disqualifier for two years from holding a

driving; license for having been found intoxicated while in charge of- a motor-ear. In June, 1930, he had procured from the Upper Hutt Borough Council a licence to drive a motor-cycle, giving his name as David Cairneross. Has excuse was that he understood the licence cancelled was for driving a motor-car and that the disqualification did not apply to motor-cycle driving. .

Mr N. A. Poden appeared for the defendant. He said that part "of the trouble was that the defendant's conviction at Pietone had not been expressed as clearly i as it might haye been. Moreover it! tad been reported in the (Press that his* licence to drive a car had been cancelled!. The defendant apparently thought he waa justified in getting a licence to drive a motor-cycle. His conduct seemed open to censure in that he made use of another Christian name to obtain the second licence,, but he explained that there was because he was known in the Upper .Hutt district as Dave Cairneross.
