DEFENDANT ADMITS DRIVING AT 43 MILES AN HOUR.
George Walter Roche pleaded guilty to driving a motor car in Puriri Street at,a speed dangerous to the public. He stated that he was travelling at 43 miles an hour and was unable to negotiate the corner with the result that he went into the ditch. .
'' You; have been very candid about it, anyway,'' remarked the to defendant, who was convicted and fined £4 and costs.
BEING ON PREMISES AFTER HOURS TWO YOUNG MEN CHARGED
CASE DISMISSED,
John Donovan Williams and Terence Wagg were charged with being found on licensed premises after hours.
Mr C. R. Barrett who appeared for defendants entered a plea.of not guilty.
Constable Tanner stated that at 7.5 p;m. on January 2nd he visited the Railway Hotel and there found two men talking to the licensee. He asked defendants what they were doing on the premises and' they stated they wanted to use. the telephone. When he went into the hotel he heard one of the men thanking the licensee for the use of the phone. Wagg was under the influence of liquor, but Williams was sober. Later he spoke to defendants,at the Post Office where, they had been. using the phone. They said they went into the, hotel to use the phone -to save one penny. .
I Terence Wagg stated that Williams and himself left Lower Hutt toy car a little before 2 o'clock in the afternoon of Januaiy 2nd to go to the Bay where they stayed all day, subsequently arriving back in Lower Hutt at 6.50 p.m. They went to the hotel to ring up their respective homes to see if tea was still on. Just as they reached the foot of the stairs the licensee met them. The licensee told the constable they wanted to use the phone. The licensee walked to thedoor with the constable and after the' constable had gone the licensee came back and advised them to leave and use somej)ther telephone to save any trouble. They then rang up from the at the post office. Wagg denied-having had any da-ink at any time during the day. J. D. Williams corroborated the evidence given by the previous witness and slated that he had known the licensee for over eight years and had often used the telephone. v .; The Magistrate said that this case was one of the .exceptions to the rule. He believed the young men, and the charges would be dismissed. ' CIVIL CASES Judgment for plaintiff by default'was given in the.following undefended- civil ' cases:— Andjina Margaret Tait v. H. W. In judgment summons cases W. Handley was ordered to pay T. Davin £10/7/----forthwijfch in default 7 days' imprisonment; J. Whittaker to pay F. "W. Maddams £8/13/5 in default 7 days' imprisonment; GK E. Croft to pay
G. E. Parker £3/8/6 within 14 days in default 3 days' imprisonment ; W. J. Smith; to pay Evans Bros $2/3/- within 14 days in'default 3 days' imprisonment; H. Palmer to pay J.. Davidson £2/14/8 forthwith in default 3 days' imprisonment. - • ' MAINTENANCE CASES Pat Nepia, who was charged with disobedience of a maintenance order, was convicted and sentenced to two months' imprisonment, the warrant fo be suspended for 14 days and he is to Nbe released, on payment of £9 and costs. . Robert Beardon who is the, subject of an application for maintenance, separation and guardianship, on .the grounds of failure to maintain, was ordered to pay £3 for the support of Ms wife, the first paymeiSfc to be made by March 12.
